The key point is that once a retiree exceeds the threshold, the corresponding rate applies to the entire amount of their pension rather than just the portion above that limit. This regulation is being challenged by a retiree who has taken legal action.
Basing on the official document from the Eλεγκτικό Συνέδριο, the central question of this case is whether applying a uniform rate to the total pension amount aligns with constitutional principles or if it should exclude a basic sum and only apply to any excess amount.
The recommendation from the General Commissioner, according to reliable legal sources, leans towards changing how calculations are made so that contributions are imposed solely on amounts exceeding this threshold. However, this recommendation does not constitute a final decision; that authority lies with the Oλομέλεια.
If this direction prevails, retirees may notice meaningful changes in their finances. For instance, for a pension of 2.000 ευρώ, if an exempted amount of 1.468 euros were applied, contributions would be calculated on €532 instead. With a rate of 7%, deductions would be around 37 ευρώ, compared to approximately 140 ευρώ strong > currently when applying 7% on the full €2.000.
The fiscal aspect
Even if there’s an inclination towards change in recommendations , actual outcomes will depend on how any new scale takes shape following judicial review . Beyond its constitutional implications ,this matter carries significant fiscal weight : EAS serves as an essential revenue source for A.K.A.G.E (Insurance Fund for Generations Solidarity) , which acts as savings for future retirement system needs. p >

The retroactive payments
< p>the second major issue concernsretroactive payments . A court ruling favoring changes in calculation methods doesn’t automatically guarantee all retirees will receive refunds covering past periods .< / p >< p>No one can rule out claims regarding time limits and issues related tostatute limitations / em>. Already associations representing retirees along with legal experts encourage filing requests withE.F.K.A / strong>, aiming at disputing current calculation methods while preserving rights and halting statute limitations.
